Terms of Service

Introduction

"What Was That?" is a daily riddle mobile app published by Yoran Yossipov. These Terms of Service ("Terms") govern your use of the "What Was That?" mobile application ("App") available on iOS and Android. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the App.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

2. Eligibility

By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly permit children under 13 to use the App. If we learn that a user is under 13, we will terminate their account and delete any associated data promptly.

3. Account Rules

The App uses anonymous Firebase Authentication to create an account for you automatically when you first launch it. No email address or password is required. The following rules apply to your account:

• You may not transfer, sell, or share your account with another person.
• You are responsible for all activity that occurs under your account.
• You may optionally set a display name for leaderboard participation. Display names must not be offensive, impersonating, or in violation of any applicable law.
• We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion.

If you wish to delete your account and all associated data, please contact us at privacy@apeakdata.com with the subject "Account Deletion Request."

4. Acceptable Use

You agree to use the App only for its intended purpose — playing the daily riddle game — and in compliance with all applicable laws and regulations. You must not:

• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
• Use any automated tool, bot, script, or other means to interact with the App, submit answers, or manipulate scores or streaks.
• Exploit bugs, glitches, or unintended features to gain an unfair advantage.
• Attempt to access, tamper with, or disrupt the App's backend services, databases, or cloud infrastructure.
• Transmit any malware, viruses, or other harmful code through the App.
• Use the App in any way that could damage, disable, overburden, or impair our servers or networks.
• Attempt to circumvent or bypass ad-serving mechanisms, including rewarded video ads that unlock clues.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violation of these rules may result in immediate account suspension or termination without notice.

5. Intellectual Property

All content within the App — including but not limited to riddles, clues, game mechanics, visual design, graphics, logos, text, and software code — is the exclusive property of Yoran Yossipov and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial entertainment. This license does not include the right to:

• Reproduce, distribute, or publicly display any App content without prior written permission.
• Create derivative works based on App content.
• Use any riddle, clue, or other App content for commercial purposes.
• Remove or alter any copyright, trademark, or proprietary notices in the App.

The share cards generated by the App (emoji result cards) may be shared freely on social media for personal, non-commercial purposes, provided they are shared in their original, unmodified form.

6. Advertising Disclosure

The App is free to download and play. It is supported by advertising served through Google AdMob. The following ad formats are used:

Rewarded video ads are strictly user-initiated — you choose to watch an ad to unlock a clue. You will never be forced to watch an ad to continue playing. Clue 1 is always free.

Ad serving is subject to Google AdMob's terms and policies. For information on how AdMob collects and uses data in connection with advertising, please see Google's Privacy Policy at policies.google.com/privacy.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YORAN YOSSIPOV DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT IN THE APP.

You use the App at your own risk. We do not warrant that the App will be available at all times, or that daily riddles will be delivered without interruption.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YORAN YOSSIPOV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, streaks, scores, or account progress.
• Loss of profits or revenue.
• Damages arising from unauthorized access to or alteration of your data.
• Any matter beyond our reasonable control.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE APP, IS ZERO).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Israel.

If you are a consumer located in the European Union, you may also have the right to bring a claim in the courts of your country of residence.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App ceases immediately.

Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — shall survive any termination of your account or these Terms.
